Scope and Acceptance

All online purchases made on the website www.nicyrparis.com (hereinafter the “Site”) are subject to the prior reading and unconditional acceptance of these General Terms and Conditions of Sale (hereinafter “GTC”) and the applicable prices.

All users can access the GTC from any page on the Site.
By validating an order following the ordering procedure on the Site, the Client accepts these GTC in full.

NICYR refers to the simplified joint-stock company (SAS) with a capital of €400, registered with the Paris Trade and Companies Register under number 983 641 556, with registered office at 41bis, rue Crozatier, 75012 Paris.

Client

The person placing an online order on the Site declares they are of legal age in their country of residence, or if a minor, confirms having parental authorization to place the order and possesses full legal capacity.
When providing personal data during order validation or account creation, the Client must ensure the accuracy of the mandatory information provided.
NICYR cannot be held responsible for non-delivery or failure to send a confirmation email if the recipient’s contact details are incorrect.

3. Article

“Article” refers to bouquets, plants, decorative objects, and other products sold on the Site.
If an Article becomes unavailable after the order is placed, the Client will be notified by email, and the order will be automatically canceled.

The characteristics of Articles displayed on the Site (photos and descriptions) are non-contractual and provided for informational purposes; they may change over time.
In case of errors or omissions regarding an Article description, NICYR’s liability is limited to reimbursing reasonable return shipping costs incurred by the Client, or providing a credit valid in-store or on the Site if return is impossible.

Recipient

The “Recipient” refers to the person receiving one or more Articles ordered by the Client.

Order

All orders are subject to prior acceptance by NICYR and are only definitively confirmed upon receipt of an email confirming shipment of the Article(s).
If the Client does not receive a confirmation email, they must contact NICYR customer service at contact@nicyrparis.com.

Before finalizing the order, the Client can review order details and total price and correct any errors. Once confirmed, the order constitutes a sales contract and acceptance of all stipulations of these GTC.
NICYR will send a confirmation email summarizing all order details before shipment. The Client must provide a valid email address.
By receiving the confirmation email, the order becomes final. Any modifications require a new order.

NICYR is not liable for non-performance or improper execution of an order due to force majeure or external causes. If NICYR’s liability is engaged, the Client may claim damages not exceeding the total amount paid for the order in question.

Prices

Prices are shown in euros, including all taxes, excluding shipping costs. Shipping fees are indicated during checkout.
For international deliveries, customs duties, local taxes, import fees, or state taxes may apply. These are the sole responsibility of the buyer.
NICYR may revise prices at any time; products are billed based on prices at the time of order.

Payment

Orders can be paid via credit card, SEPA direct debit, PayPal, or installment payment.
All transactions are processed through a secure online payment platform.

Delivery

Decorative objects and stabilized flower arrangements are shipped Monday to Friday.
Live plants and bouquets are delivered in Paris and neighboring municipalities during NICYR boutique opening days at 66, avenue de Saint-Mandé.
NICYR will contact the Client and/or Recipient by phone or email to organize delivery.

Delivery times listed on the Site are indicative; delays do not entitle the Client to cancel, refuse, or claim damages.
NICYR is not responsible for consequences of delayed delivery.

Returns

If an Article does not match the Client’s order, is damaged during transport, or fails to meet expectations, it may be returned to NICYR.
The Client must return the non-compliant Article to obtain a refund. Shipping costs will be reimbursed if the return is justified by a clear defect or non-compliance with the order.

Right of Withdrawal

In accordance with national and European consumer protection laws, the Client has 14 calendar days from receipt to exercise the right of withdrawal without justification or penalties, except possibly return shipping fees.

Returned Articles must be properly protected and in resalable condition.

Warning

Sales on the Site are exclusively for retail and private customers. Professional buyers must contact NICYR via email for orders.
The Client acknowledges that Articles can only be purchased in quantities corresponding to average consumer needs. NICYR reserves the right to refuse orders clearly made by professional sellers.

The applicable GTC are those in force on the Site at the date of order placement.

Claims for online purchases must be made through the Site.
Articles purchased in physical stores cannot be addressed via the Site but only in-store at 41bis, rue Crozatier, or other pop-up locations.

Applicable Law

These GTC are governed by French law.
Any disputes fall under the exclusive jurisdiction of the Paris courts, unless an amicable agreement is reached.
